BackgroundThe U.S. Food and Drug Administration traditionally has kept confidential significant amounts of information relevant to the approval or non-approval of specific drugs, devices, and biologics and about the regulatory status of such medical products in FDA’s pipeline.ObjectiveTo develop practical recommendations for FDA to improve its transparency to the public that FDA could implement by rulemaking or other regulatory processes without further congressional authorization. These recommendations would build on the work of FDA’s Transparency Task Force in 2010.MethodsIn 2016-2017, we convened (...) a team of academic faculty from Harvard Medical School, Brigham and Women’s Hospital, Yale Medical School, Yale Law School, and Johns Hopkins Bloomberg School of Public Health to develop recommendations through an iterative process of reviewing FDA’s practices, considering the legal and policy constraints on FDA in expanding transparency, and obtaining insights from independent observers of FDA.ResultsThe team developed 18 specific recommendations for improving FDA’s transparency to the public. FDA could adopt all these recommendations without further congressional action.FundingThe development of the Blueprint for Transparency at the U.S. Food and Drug Administration was funded by the Laura and John Arnold Foundation. Thomas Jefferson and Philosophy: Essays on the Philosophical Cast of Jefferson’s Writings is a collection of essays on topics that relate to philosophical aspects of Jefferson’s thinking over the years. Much historical insight is given to ground the various philosophical strands in Jefferson’s thought and writing on topics such as political philosophy, moral philosophy, slavery, republicanism, wall of separation, liberty, educational philosophy, and architecture.

This study statistically analyzes two-year college students' attitudes toward cheating via a survey containing academic and business situations that the students evaluated on a seven point scale from unethical to ethical. When both the general questions concerning attitudes about cheating and the opinions on the ethical statements are considered, the business students were generally more unethical in their behavior and attitudes than non-business majors. These results indicate a need for more ethical exposure in business courses to help students distinguish ethical (...) from unethical decisions. (shrink)

Since its inception in September 2010, the Network for Public Health Law has responded to hundreds of public health legal technical assistance claims from around the country. Based on a review of these data, a series of major trends in public health practice and the law are analyzed, including issues concerning: the Affordable Care Act, tobacco control, emergency legal preparedness, health information privacy, food policy, vaccination, drug overdose prevention, sports injury law, public health accreditation, and maternal breastfeeding. Public health law research reveals significant complexities underlying the use of law as an effective tool to improve health outcomes across populations. The challenges of applying public health law in practice are no easier. Attorneys, public health officials, and diverse partners in the public and private sectors collaborate on the front lines to forge pathways to advance population health through law. Meeting this objective amidst competing interests requires strong practice skills to shift through sensitive and sometimes urgent calls for action (...) to address known threats to the health of individuals and the community. Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. BACKGROUND: There is a need for interdisciplinary research to better understand how pedagogical approaches in primary physical education (PE) can support the linked development of physical, cognitive and affective aspects of physical literacy and physical activity behaviours in young children. The Skill Acquisition Methods fostering Physical Literacy in Early-Physical Education (SAMPLE-PE) study aims to examine the efficacy of two different pedagogies for PE, underpinned by theories of motor learning, to foster physical literacy, especially for children living in disadvantaged areas. METHODS: (...) SAMPLE-PE will be evaluated through a cluster-randomised controlled trial targeting 5-6 year old children from schools located in areas of high deprivation in Merseyside, North-West England. Schools will be randomly allocated to one of three conditions: Linear Pedagogy, Nonlinear Pedagogy or Control. Nonlinear and Linear Pedagogy intervention primary schools will receive a PE curriculum delivered by trained coaches over 15 weeks, while control schools will follow their usual practice. Data will be collected at baseline (T0), immediately post-intervention (T1) and six months after the intervention has finished (T2). Children’s movement competence is the primary outcome in this trial. Secondary outcomes include physical activity, perceived competence, motivation, executive functions, and self-regulation. An extensive process evaluation will also examine implementation factors such as intervention context, reach, dose, fidelity and acceptability. DISCUSSION: The SAMPLE-PE project will enable better understanding surrounding how to operationalise physical literacy through enrichment of PE practices in early PE. The study will provide robust scientific evidence regarding the efficacy of underpinning PE pedagogy with theories of motor learning to promote the development of physical literacy. (shrink)

BackgroundDespite rapid growth of the scientific literature, no consensus guidelines have emerged to define the optimal criteria for editors to grade submitted manuscripts. The purpose of this project was to assess the peer reviewer metrics currently used in the surgical literature to evaluate original manuscript submissions.MethodsManuscript grading forms for 14 of the highest circulation general surgery-related journals were evaluated for content, including the type and number of quantitative and qualitative questions asked of peer reviewers. Reviewer grading forms for the seven (...) surgical journals with the higher impact factors were compared to the seven surgical journals with lower impact factors using Fisher’s exact tests.ResultsImpact factors of the studied journals ranged from 1.73 to 8.57, with a median impact factor of 4.26 in the higher group and 2.81 in the lower group. The content of the grading forms was found to vary considerably. Relatively few journals asked reviewers to grade specific components of a manuscript. Higher impact factor journal manuscript grading forms more frequently addressed statistical analysis, ethical considerations, and conflict of interest. In contrast, lower impact factor journals more commonly requested reviewers to make qualitative assessments of novelty/originality, scientific validity, and scientific importance.ConclusionSubstantial variation exists in the grading criteria used to evaluate original manuscripts submitted to the surgical literature for peer review, with differential emphasis placed on certain criteria correlated to journal impact factors. Gianelli (bio)As most readers of this column already know, the President's Council on Bioethics went through a major transition during the past year when Leon Kass—in October 2005—handed the chairman's gavel over to Georgetown University's Edmund Pellegrino. Dr. Kass has remained on the Council as a member.1When the gavel change took place, the Council's phone started (...) ringing. Everyone wanted to know the same thing: What topics would the Council take up this term? Dr. Pellegrino's answer was always the same: The Council's agenda would be established through a consultative process with the members themselves and with an eye to those problems and controversies in bioethics to which we, as a body, can make a contribution.Taking its cue from the list of potential topics suggested by members, the Council—over the course of the next several meetings—listened to experts on such topics as children and bioethics (with a focus on children in clinical research), organ transplantation, and that oft-cited-but-hard-to-define concept, "human dignity."The latter topic entered the arena of discussion because it is a concept that is cited frequently in the bioethics literature, and it is also one that has figured prominently in Council discussions and documents. Although the concept is widely invoked, there is no universal understanding of what it means, and it is not easy to encapsulate into a one-size-fits-all definition. Indeed, some critics maintain that appeals to human dignity are fig leaves used to camouflage unconvincing arguments. So between December 2005 and April 2006, the Council devoted several sessions to various perspectives on "human dignity: its meaning, its foundations, and its relevance to bioethics." After hearing from James Childress, Patricia Churchland, Daniel Sulmasy, and Paul Weithman2 on the topic, the Council decided to issue a volume of approximately 20 essays, some by Council members and others by scholars from a variety of relevant disciplines.3 The volume is expected to encompass a broad array of opinion on the topic of human dignity and is scheduled to be published next spring."Children" were also the focus of several sessions during the past year. The Council's last report addressed care giving for the elderly.4 After it was issued, several members suggested it was time to focus on the youngest members of [End Page 375] society. The challenge, of course, was to find a topic that was both timely and relevant—and one about which the Council was uniquely qualified to make a contribution. A number of experts in a variety of related fields testified before the Council about possible issues it could explore: newborn screening for genetic disorders; decision-making standards for those who lack capacity; ethical issues in neonatal and pediatric intensive care; pharmacology and psychiatric disorders in children; and children and clinical research. In addition, a number of groups and individuals involved in related topics met with staff to discuss their interests and concerns.This exploratory engagement with facets of the broad topic of children and bioethics led the Council to focus, more narrowly, on a cluster of issues concerning newborn screening for genetic disorders—a topic on which it is likely that the Council will issue a white paper, possibly by next summer. The stimulus for this particular focus has been the American College of Medical Genetics's recommendation that all newborns in the U.S. be screened for a panel of 29 disorders.5 Currently, each state decides for its residents which conditions are subject to mandated screening, so it is possible to get early diagnoses of treatable disorders in one geographical area but not in another. Proponents of screening find the federal approach to mandated screening more equitable. Potential ethical problems, however, exist with the proposal. Some want to ensure that newborns are screened only for treatable conditions on grounds that it would be too burdensome to discover one is carrying the gene for a late-onset disease that cannot be prevented. Linguistic anthropologists have studied emotion in societies around the world for several decades. This article defines the discipline, introduces its general relevance to emotion theory, then presents five of the most important contributions linguistic anthropology has made to the study of emotion.

In recent years sociological research on social movements has identified emotional dynamics in all the basic processes and phases of protest, and we are only beginning to understand their causal impacts. These include the solidarities of groups, motivations for action, the role of morality in political action, and the gendered division of labor in social movements. Anger turns out to be at the core of many of these causal mechanisms.

Among the reasons that Whitehead is such an interesting philosopher is that his work resonates across philosophical traditions. This collection develops connections between Whiteheadian concepts and recent European thinkers. The purpose is not simply to compare, however, but, as editor Jeremy Fackenthal suggests, to develop a Whiteheadian thinking “in tandem” with European philosophers in order to create disruptions or “dislocations” in thought that can engender creative approaches to contemporary problems.One general feature of the book deserves mention at the outset, though (...) I will return to it later in the review: although phenomenology and hermeneutics are each represented in the volume, roughly half of the essays focus on the work of Gilles Deleuze (if we group these together with essays focused on “new materialism,” which is connected with Deleuze, the proportion is more like two-thirds). This will be no surprise, since Deleuze is the European philosopher who was most appreciative of Whitehead. And yet, the result is that the conversation with “continental philosophy” is highly selective.The book is organized into three parts, each comprised of three essays. In part 1, “Technological and Systematic Dislocations,” William S. Hamrick brings Whitehead into conversation with Maurice Merleau-Ponty's concept of “the flesh” to suggest an ecological ontology capable of overcoming the instrumentalization of nature. Hamrick's strategy is to read Whitehead and Merleau-Ponty as contributing to an “ontological foundation” for a sustainable civilization (18). Bo Eberle writes about the “quantified self” suggested in new, wearable self-monitoring technologies. Drawing on Whitehead's notion of causal efficacy, Eberle argues that devices such as Fitbit give us access to bodily states that bypasses the standard ways we are aware of ourselves (i.e., through consciousness). He goes further to argue that, like all ways of knowing, wearable technologies are selective, and that the selection reflects the interests of the manufacturers and promotes a certain kind of subjectivity (in the case of Fitbit, a subjectivity that is oriented toward “getting your steps in”). Whitehead's epistemology thus enables the critic of wearable technologies to understand how contemporary experience and self-understanding is shaped not simply by recent technological mediations but by the material interests embedded in them. J.R. Hustwit and Carl Dyke take on what they call “activist” uses of Whitehead that naively (in their judgment) suggest that a non-relational substance metaphysics is to blame for most of our social ills. They employ the theory of complex adaptive systems in conversation with Whitehead and Antonio Gramsci to show that, in fact, achieving significant social change is far more difficult and even unpredictable than mere insertion of better ideas into public discourse. Dominant hegemonies have ways of adapting and absorbing attempts to undermine them. Here Hustwit and Dyke draw on the philosophy of Paul Ricoeur to suggest that resistance to the dominant hegemony is nevertheless always possible because of the vagueness of discourse, allowing a plurality of competing interpretations and thus fractures in the dominant hegemony. However, even this kind of resistance is impossible to control and its effects incapable of being entirely predicted. To the essay's titular question, “Can Whitehead save the world?” the authors answer, “No.”In part 2, “Animal/Human Dislocations,” Jeremy Fackenthal draws on the new materialism of Rosi Braidotti (and Deleuze) along with Whitehead to argue for a “process-relational” nomadism that culminates in a “becoming-imperceptible.” His reading together of Whitehead and Braidotti creates the opportunity to recast the former's concept of objective immortality in such a way that it does not refer to death so much as to being diffused into a relational network. The satisfaction of an actual occasion may be taken as its translation into its effects among its relations. Fackenthal argues that this becoming-imperceptible makes possible a sustainable presence within a fragile network of life. Deena M. Lin uses Whitehead, Braidotti, and Judith Butler to lay out a vision of human life as precarious and deserving attention, care, and solidarity. She presses this vision as a direct moral assault on US (Trump's) policy toward Syrian refugees. Going further, she draws on Braidotti's posthuman account of zoe to argue for universal connection and solidarity with all life that should foster, as the title of her essay puts it, “Welcoming of Syrian Life.” Tano Posteraro offers an intriguing essay drawing on Jakob von Uexküll's account of animal experience. Posteraro argues that Uexküll's notion of an animal's Umwelt, shaped by its distinctive perceptual apparatus, needs to be supplemented by Whitehead's notion of prehension to account for the active dimension of animal perception. Rather than a passive registering of animal environments, Posteraro argues that the latter are constructed, and that concepts (or conceptual prehensions) should be understood as tools with which such environments are constructed.In part 3, “Time, the World, and Abstraction,” three essays probe ways that Whiteheadian and Deleuzian themes may resonate critically and constructively. Kris Klotz brings the thought of Whitehead and Deleuze together to inquire about how alternatives to present social forms are envisioned. He argues that, for Whitehead, every actual occasion involves a selection of some features of the past, and, further, that every selection is also an abstraction from the concrete welter of influences impinging on it. For Whitehead, then, to envision alternatives involves a critique of abstractions, a reinstatement of the concrete plurality of possibilities. This, for Whitehead, is what rationality does: it works at restoring the concrete, and, with it, a series of alternatives that have been eclipsed. To this Whiteheadian analysis, Klotz adds Deleuze and Guattari's critique of “opinion.” For Deleuze and Guattari, opinion is not an idiosyncrasy but a consensus to which differences of experience are subjected. Philosophy, for Deleuze and Guattari, must always struggle against opinion in order to bring alternatives to light. These conceptions of reason/philosophy, Klotz argues, represent useful ways to critique inequalities and other social wrongs that are embedded in the social forms that are routinely taken for granted. Elijah Prewitt-Davis uses a scene from Buffy the Vampire Slayer, along with philosophical innovations of Foucault, Deleuze, and Whitehead, to offer a distinctive account of power. Prewitt-Davis calls attention to Deleuze's important book on Leibniz, The Fold, and to how Whitehead's concept of prehension lies at its center. The upshot is that power is not reduced to dominance but, instead, is at work wherever any occasion of experience persists amid the onslaught of the influence of other occasions. Power, as Deleuze wrote, is the capacity to be affected—and to decide how to constitute oneself anew. Keith Robinson offers a detailed account of Whitehead's epistemology along with a reading of Deleuze's analysis of temporality to suggest that there is a common trajectory that seeks to undermine what the title of the essay describes as the “Bifurcation of Nature” (i.e., the separation of natural phenomena and human experience) within the dominant Western philosophical tradition.There is much of value in the volume as a whole. Aside from staging what Spinoza might have called good encounters between Whitehead and a number of continental philosophers, enhancing the conceptual power of each, the contributors are able to make a case that these philosophical trajectories, when read together, have much to contribute to our understanding of and response to the pressing issues of the day. In addition, readers who are interested in the relationship between Whitehead and the new materialism will find this volume to be a helpful resource, stocked with fine examples of how to sharpen new materialist thinking with Whitehead and how to read contemporary contexts through these lenses. On the other hand, this book is not a handbook nor a comprehensive reference. The organizational logic behind its division into sections is murky and the amount of attention given to particular continental philosophers as opposed to others appears somewhat arbitrary: there are recent continental philosophers who get little to no attention at (Derrida, Malabou, Žižek, Agamben, Latour, Nancy, for example), several of whom might prove to be quite interesting to read “in tandem” with Whitehead. The major technical advance offered by the book is a 'representation theorem' that shows that both causal decision theory and its main rival, Richard Jeffrey's logic of decision, are both instances of a more general conditional decision theory. The book solves (...) a long-standing problem for Jeffrey's theory by showing for the first time how to obtain a unique utility and probability representation for preferences and judgements of comparative likelihood. The book also contains a major new discussion of what it means to suppose that some event occurs or that some proposition is true. Perception is fascinating and is inextricably bound up with all levels and kinds of thinking. Perceptual knowledge, descriptive data, serves as raw material for any and all processing operations. Certainly all kinds of constructing and processing operations await, e.g., imagining, describing, generalizing, comparing, day-dreaming, thousands of kinds. The mind is constantly at work with its symbols, such as images and language, formulating and focusing percepts out of sensory stimuli and then making thought and feeling constructs.

The pragmatic character of the Dutch book argument makes it unsuitable as an "epistemic" justification for the fundamental probabilist dogma that rational partial beliefs must conform to the axioms of probability. To secure an appropriately epistemic justification for this conclusion, one must explain what it means for a system of partial beliefs to accurately represent the state of the world, and then show that partial beliefs that violate the laws of probability are invariably less accurate than they could be otherwise. The first task can be accomplished once we realize that the accuracy of systems of partial beliefs can be measured on a gradational scale that satisfies a small set of formal constraints, each of which has a sound epistemic motivation. When accuracy is measured in this way it can be shown that any system of degrees of belief that violates the axioms of probability can be replaced by an alternative system that obeys the axioms and yet is more accurate in every possible world. Since epistemically rational agents must strive to hold accurate beliefs, this establishes conformity with the axioms of probability as a norm of epistemic rationality whatever its prudential merits or defects might be. Making matters worse, many human participants protection instruction programs - now mandated by IRBs - offer inadequate reasons why researchers should comply with regulations and IRBs. Promoting compliance either for its own sake or to avoid penalties is contrary to the developmental aims of moral education and may be ineffective in fostering the responsible conduct of research. This (...) article explores the concept of professional virtue and argues that compliance is capable of becoming a professional virtue like scientific honesty. This requires, however, that regulatory and IRB demands contribute to human well-being and to the aims of research as a profession and that researchers, therefore, internalize the norms that underlie regulatory and IRB demands. This, in turn, requires a series of changes in the way society develops, promulgates, and enforces regulatory and IRB rules. The challenge is, simply put, to embed compliance into the world of living morality. (shrink)

In this paper, we report on the development and validity of the Professional Decision-Making in Research measure, a vignette-based test that examines decision-making strategies used by investigators when confronted with challenging situations in the context of empirical research. The PDR was administered online with a battery of validity measures to a group of NIH-funded researchers and research trainees who were diverse in terms of age, years of experience, types of research, and race. The PDR demonstrated adequate reliability and parallel form (...) correlation. As hypothesized, the PDR was significantly negatively correlated with narcissism, cynicism, moral disengagement, and compliance disengagement; it was not correlated with socially desirable responding. In regression analysis, the strongest predictors of higher PDR scores were low compliance disengagement, speaking English as a native language, conducting clinical research with human subjects, and low levels of narcissism. Given that the PDR was written at an eighth grade reading level to be suitable for use with English as a second language participants and that only one-fourth of items focused on clinical research, further research into the possible roles of culture and research ethics training across specialties is warranted. This initial validity study demonstrates the potential usefulness of the PDR as an educational outcome assessment measure and a research instrument for studies on professionalism and integrity in research. This study examined whether undergraduate students’ perceptions regarding the acceptability of cheating were influenced by the amount of ethics instruction the students had received and/or by their personality. The results, from a sample of 230 upper-level undergraduate students, indicated that simply taking a business ethics course did not have a significant influence on students’ views regarding cheating. On the other hand, Machiavellianism was positively related to perceiving that two forms of cheating were acceptable. Moreover, in testing for moderating relationships, the (...) results indicated that the extent to which taking a business ethics course influenced attitudes varied substantially across individuals. Specifically, taking a course in business ethics did result in students who scored lower on Machiavellianism holding even more negative views regarding certain forms of cheating. In addition, individuals with higher grade point averages (GPAs) who had taken a course in business ethics were also less accepting of certain forms of cheating than individuals with similar GPAs who had not taken the business ethics course. There exists a common view that for theories related by a ‘duality’, dual models typically may be taken ab initio to represent the same physical state of affairs, i.e. to correspond to the same possible world. We question this view, by drawing a parallel with the distinction between ‘interpretational’ and ‘motivational’ approaches to symmetries.

In classical theism, God is typically conceived of as having the attribute of omnipresence. However, this attribute often falls prey to two puzzles, the immateriality puzzle and the intensity puzzle. A recent explication of omnipresence by Hud Hudson falls short of solving these puzzles. By attending to key narratives in the Hebrew Scriptures, I argue that one ought to conceive of God’s presence at a location as God’s acting at that location. Thus, God’s omnipresence is God’s acting at all locations.

In the world of research, compliance with research regulations is not the same as ethics, but it is closely related. One could say that compliance is how most societies with advanced research programs operationalize many ethical obligations. This paper reports on the development of the How I Think about Research questionnaire, which is an adaptation of the How I Think questionnaire that examines the use of cognitive distortions to justify antisocial behaviors. Such an adaptation was justified based on a review (...) of the literature on mechanisms of moral disengagement and self-serving biases, which are used by individuals with normal personalities in a variety of contexts, including research. The HIT-Res adapts all items to refer to matters of research compliance and integrity rather than antisocial behaviors. The HIT-Res was administered as part of a battery of tests to 300 researchers and trainees funded by the US National Institutes of Health. The HIT-Res demonstrated excellent reliability. Construct validity was established by the correlation of the HIT-Res with measures of moral disengagement, cynicism, and professional decision-making in research. The HIT-Res will enrich the set of assessment tools available to instructors in the responsible conduct of research and to researchers who seek to understand the factors that influence research integrity.
